Draft for Cloudtel review. This policy was written from scratch because the existing Privacy Statement link resolves to a placeholder page. Every clause below reflects standard obligations under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, but the specifics of what Cloudtel collects, how long it is kept and who it is disclosed to must be confirmed by Cloudtel and reviewed by a lawyer before this is published.
Who this covers
CloudTel Pty Ltd ("Cloudtel", "we", "us") supplies carrier services from Suite 10, 320 Harris Street, Pyrmont, Sydney NSW 2009, with operations in Australia and New Zealand. This policy explains how we handle personal information, and applies to our website, our products and the services we operate for clients.
We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles. As a carriage service provider we are also bound by Part 13 of the Telecommunications Act 1997, which restricts the use and disclosure of information about communications carried across our network.
What we collect
The information we hold falls into three groups.
- Contact and account information. Name, business name, email address, telephone number, postal address, billing details and the correspondence you send us.
- Service records. Call detail records, message records, numbers dialled, times, durations, routing data and usage volumes generated when our services carry your traffic or your customers' traffic.
- Website information. What you submit through the enquiry form, plus ordinary server logs including IP address, browser type and pages requested.
We do not seek sensitive information as defined by the Privacy Act, and ask that you do not send it to us unless a service genuinely requires it.
Why we collect it
- To supply, provision, bill and support the services you have asked for.
- To provide the statistics and reporting that come with your account.
- To investigate faults, misuse and suspected fraud.
- To meet obligations imposed on carriage service providers by Australian law.
Where we cannot collect the information we ask for, we may not be able to supply the service.
Who we disclose it to
We disclose personal information to upstream carriers and suppliers where that disclosure is necessary to carry traffic or provision a number, including relationships with Telstra, Verizon, Vocus, AAPT, Telecom New Zealand and Vodafone. We also disclose information to law enforcement, regulators and other authorities where the law requires or authorises it, and where we identify usage of a service that we reasonably believe to be fraudulent.
We do not sell personal information, and we do not disclose it for another organisation's direct marketing.
Overseas disclosure
Cloudtel operates in both Australia and New Zealand, so information may be accessible from or disclosed to our New Zealand operations. Where traffic is carried internationally, records may also pass to overseas carriers in the ordinary course of routing a call or message.
How it is held and secured
Our critical infrastructure is at Global Switch Sydney. We take reasonable steps to protect personal information from misuse, loss and unauthorised access, including restricting access to staff who need it to do their work. No system is perfectly secure, and we cannot guarantee the security of information transmitted to us over the internet.
We keep information for as long as we need it for the purpose it was collected, and for as long as the law requires us to retain it, after which we take reasonable steps to destroy it or ensure it is de-identified.
Accessing and correcting your information
You can ask for access to the personal information we hold about you, and ask us to correct it if it is wrong. Write to the address below. We will respond within a reasonable period. If we refuse access or refuse to correct a record, we will tell you why in writing.
Cookies
This website does not set advertising or tracking cookies. Our web server keeps ordinary access logs. Fonts on this site are requested from Google Fonts, which means Google receives the IP address of your request.
Complaints
If you think we have mishandled your personal information, contact us first at contact@cloudtel.com.au or on +61 (0)2 9280 2670. We will investigate and respond in writing.
If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992. Complaints about a telecommunications service can also go to the Telecommunications Industry Ombudsman at tio.com.au or on 1800 062 058.
Changes
We may update this policy. The current version always sits at this address, with the date of the last change shown at the top.
